PRIVACY POLICY

On May 25, 2018, new European data protection legislation went into effect. This is the General Data Protection Regulation (GDPR).
This new regulation provides a stricter framework for the use of personal data by companies.
Aware of the importance of protecting your data, Planète Enfants & Développement (PE&D) complies with this regulation. PE&D is committed to limiting the collection of personal data to what is strictly necessary, in compliance with data minimization.

TREATMENTS

  1. What data?

The categories of data processed include identification data to communicate with you, to get to know you better and to facilitate the relationship with PE&D.
When you make a donation, a purchase, are involved in a process of passing on your estate, respond to a survey or participate in a mobilization operation, we could also collect :
- Your bank details (excluding credit card numbers);
- your date of birth ;
- Information related to your donation, your purchase or your project of transmission of patrimony.your data are collected through paper or digital forms.the information collected on the forms of the site https://planete-eed.org are recorded in a computerized file by Planète Enfants & Développement.

2. What treatments? PE&D uses your data to carry out our missions:

- Manage our donation collection activity, as well as our testator relations
- Promote and raise awareness about our projects and activities
- Knowing you and staying in touch with you
- Study and improve our fundraising campaigns
- Manage and execute your online orders
- Respond to your applications
- They are intended for the Collection and Communication department, the Human Resources department of Planète Enfants & Développement, our service providers who are subject to a confidentiality agreement and the competent authorities who may request it, in accordance with the legislation.
We do not sell or trade your information to any third party or other charitable organization.

3. Legal basis of the processing

Personal data may be lawfully collected and used if this is necessary for the legitimate interests of the organisation using the data, provided that such use of the data is fair and does not infringe the rights of the data subject. Thus, we may process your data on the basis of:
- Consent of the person
- The need to respect a legal obligation, such as sending you your tax receipt
- Fulfillment of a contract, such as sending you your orders online
- Your legitimate interests, such as raising awareness of our actions.

4. Shelf life

We do not keep your personal data for longer than is necessary for the purposes for which they are processed.
These retention periods are determined on the basis of the legal obligations to which we are subject and on the basis of PE&D's operational needs in relation to the processing of your data.
Your personal data is kept securely for as long as it is held by PE&D and may be archived securely if we are required to keep it for a longer period of time (for example, in the context of an estate transfer project).

5. Security Measures

We take all appropriate technical and organizational measures and precautions to protect your personal data from loss, misuse or alteration.
In particular:
- All PE&D staff are aware of the protection and security of your personal data and are subject to a confidentiality agreement
- Our site is secure
We make regular backups of data to prevent loss or damage
- We have implemented a data access clearance policy so that only authorized individuals can access your personal data.

YOUR RIGHTS

We detail each of your rights below as well as how to exercise your rights.You entrust us with your data and we thank you for your trust. However, you have basic rights to that data, in particular:

  • The right to request access to the processed data,
  • The rectification or deletion of the data, or
  • a restriction of the processing operation relating to the data subject, or
  • The right to object to the processing and
  • The right to data portability.

Where you give consent to the processing of your data, you may withdraw that consent at any time without affecting the lawfulness of the processing based on the consent given prior to the withdrawal of consent.
You have the right to lodge a complaint with the Control Authority.

2. Right of access

You have the right to obtain confirmation as to whether or not your data is being processed by our services.
In particular, you are entitled to:

a) To know the purpose(s) of their treatment(s)

b) To know the categories of data concerned by the processing

c) To know the recipients or categories of recipients to whom the data have been or will be communicated, in particular recipients who are established in third countries or international organizations

d) To know, the duration of conservation

e) To ask us to rectify or delete your data, or to limit the processing of your data, or to object to the processing of your data

f) To lodge a complaint with a supervisory authority

g) Where personal data has not been collected directly from you, to obtain information about its source

h) To be informed of automated decision making, including profiling

i) Where your data is transferred to a third country or to an international organization, to obtain information about the appropriate safeguards in relation to that transfer. You may obtain a copy of your data being processed and we may require payment of a reasonable fee based on administrative costs for any additional copies requested.
When you submit your application electronically, the information is provided in a commonly used electronic format, unless you request otherwise.
This right to obtain a copy of your data must not infringe the rights and freedoms of others. To this end, we will ask you to provide proof of your identity.

3. Right of rectification

You have the right to obtain, as soon as possible, the rectification of data that would be inaccurate.
In view of the purposes of the processing, you have the right to have incomplete data completed, including by providing an additional declaration.

4. Right to erasure ("Right to be forgotten")

This right translates into the right to obtain the deletion of your data as soon as possible.
We are required to delete your data when one of the following reasons applies:
a) Your data is no longer necessary for the purposes for which it was collected or otherwise processed;
b) You withdraw the consent on which the processing is based and there is no other legal basis for the processing;
c) You object to the processing and there is no compelling legitimate reason for the processing, or you object to the processing for canvassing purposes, you may exercise this right at any time, including profiling insofar as it is related to such canvassing;
d) Your data has been processed unlawfully;
e) Your data must be deleted to comply with a legal obligation under Union law or the law of the Member State to which we are subject;
(f) If we have made public data that we are required to erase, taking into account available technology and the costs of implementation, we will take reasonable steps, including technical steps, to inform other data controllers who process your data that you have requested its erasure, through any links to or copies or reproductions of such data.
g) Note, however, that this right does not apply to the extent that the processing is necessary:
1. To the exercise of the right to freedom of expression and information,
2. To comply with a legal obligation that requires the processing, provided for by the law of the Union or by the law of the Member State to which we are subject, or to perform a task in the public interest or in the exercise of official authority vested in us,
3. For archival purposes in the public interest, for scientific or historical research or for statistical purposes,
4. The establishment, exercise or defense of legal rights.

RELEASE OF LIABILITY

While we have made every effort to ensure the reliability of the information contained on this website, PE&D can not incur any liability for errors, omissions, or for the results that could be obtained through the use of this information.PE&D is only bound by an obligation of means concerning the information it makes available to persons who access its website. The site Planète Enfants & Développement offers hyperlinks to other sites, which are external to the Association and over which Planète Enfants & Développement has no control. Planète Enfants & Développement declines consequently any responsibility as for their contents.

COMMITMENTS

PE&D is committed to :

- Inform you immediately if PE&D considers that an instruction constitutes a violation of the European Data Protection Regulation or any other provision of Union or Member State law relating to data protection.
In addition, if PE&D is required to transfer data to a third country or international organization under Union law or the law of the Member State to which it is subject, it must inform you of this legal obligation prior to processing, unless the law concerned prohibits such information on important public interest grounds
- Guarantee the confidentiality of personal data
- Ensure that persons authorized to process personal data under this contract: or undertake to respect confidentiality or are subject to an appropriate legal obligation of confidentiality or receive the necessary training in the protection of personal data
- Consider the principles of data protection by design and data protection by default for its tools, products, applications or services.
